COMPETITION TERMS & CONDITIONS
1. DEFINITIONS
“Competition” means the MySchoolAct online musical talent competition and, in respect of each individual entrant, that Competition for which the entrant has correctly submitted his/her entry and in respect of which he/she has accepted the T&Cs;
“Competition Finalist” means (in respect of each Competition) any entrant judged to be one of the ten finalists of such Competition;
“Composition” means a musical or literary work (a written song);
“Cyber Bullying Policy” means the Promoter’s bullying policy in respect of the Competition as accessed via the Website;
“Exclusivity Period” means the period of the Competition (in which the entrant is registered) and the period of 50 days after the end of the Competition, provided that if Sony enters into a Sony Recording Agreement or Sony Management Agreement with the entrant, the Exclusivity Period shall extend until agreement by all parties of the terms of such Agreements;
“Grand Finalist” means (in respect of each Competition) any entrant judged to be one of the five grand finalists of the Competition;
“Performance” means the entrant’s music-based performance as submitted in the form of a Recording;
“Privacy Policy” means the Promoter’s privacy policy in respect of the Competition, as accessed on the Website;
“Prize” means the prize(s) awarded to the Winner of the Competition in each instance, as more particularly detailed in these T&Cs and on the Website;
“Promoter” means the promoter and operator of the Competition being MySchoolAct Pty Limited;
“Publishing Agreement” means an exclusive publishing agreement with Sony Publishing;
“Recording” means the audiovisual recording submitted as an entry to the Competition;
“School” means in each instance the school attended by an entrant to the Competition;
“School Representative” means the official representative of each School (being a Principal, teacher or other person of authority) confirmed to the Promoter as overseeing entries to the Competition by students of that School;
“Sony” means Sony Music Entertainment Australia Pty Limited;
“Sony Management Agreement” means an exclusive management agreement between Sony or an entity affiliated with Sony and the entrant, in respect of such entity’s management of all of the entrant’s activities in the entertainment industry, throughout the world;
“Sony Publishing” means Sony/ATV Music Publishing (Australia) Pty Limited;
“Sony Recording Agreement” means an exclusive agreement between Sony and the relevant entrant, in respect of the entrant’s ongoing recording activities and recordings made by that entrant;
“T&Cs” means these Terms & Conditions;
"Website” means the MySchoolAct website at URL www.myschoolact.com;
“Winner” means the winner of any particular Competition.
2. TERMS & CONDITIONS
2.1 Acceptance of these T&Cs is required as a condition of entry to the Competition. By accepting the T&Cs the entrant is confirming that he/she has read and understood the T&Cs and will comply with the T&Cs. All of the T&Cs are legally binding on the entrant.
2.2 By accepting the T&Cs and entering the Competition, the entrant accepts and agrees to be bound by the Cyber Bullying Policy.
2.3 By entering the Competition, the entrant agrees the terms of the Privacy Policy, the Cyber Bullying Policy and the User Conduct Policy, as contained on the Website.
3. GENERAL INFORMATION REGARDING THE COMPETITION
3.1 All details regarding the Competition can be found at the Website. If you have any questions, feel free to email the Promoter by accessing the “Contact Us” page on the Website.
3.2 Employees of the Promoter and their immediate families, and the employees (and their immediate families) of all agencies and companies associated with the Competition, are not permitted to enter the Competition. If such parties enter the Competition, the Promoter may be obliged to, and shall have the right to, disqualify them.
3.3 The Competition is based on the skill and talent of the entrants and chance plays no part in determining the Winner.
3.4 It is intended that the Competition will be run once per year, with the dates of each Competition being confirmed on the Website. The Website will state the dates by which all entries must be submitted, in respect of each Competition.
3.5 The Promoter accepts no responsibility for incorrect contact details provided by entrants, which may result in the entrant’s entry not being processed at any stage during the Competition (if the entrant cannot be contacted).
3.6 Each entrant is solely responsible for any costs associated with creating and/or submitting the Performance, and attending/performing at the grand final event if chosen as one of the Grand Finalists.
3.7 Online entry to the Competition is free, however internet connection rates may apply (which are payable by the entrant). Entrants must obtain the permission of the person who pays for any such internet connection.
4. HOW TO ENTER THE COMPETITION
4.1 Entry to the Competition is available to anyone between (and including) the ages of 12 to 20 and who the majority of contributing members attending secondary school for the duration of the Competition for which the entrant has entered.
4.2 Each entrant may only submit that entrant’s own Performance. Throughout the Competition the entrant may have the chance to update or modify the submitted Performance, as notified by the Promoter.
4.3 The entrants from each School must ensure that the School has registered at the Website. If no School is registered, students at that School must email the Promoter by accessing the “Contact Us” page on the Website.
4.4 Each entrant will register their entry to the Competition and submit the Recording(s) of the Performance via the Website, completing the relevant form to confirm their full legal name, their email address, their School.
4.5 The Promoter will automatically notify MySchoolAct of the submitted Performance and will await verification by MySchoolAct of the entry, and confirmation that the Performance is approved by the MySchoolAct for the Competition.
4.6 Once MySchoolAct has approval the Performance, the Promoter will confirm to the entrant his/her successful entry to the Competition.
4.7 Entries are deemed accepted at the time of confirmation by the Promoter pursuant to 4.6 above, and not at the time they are uploaded. Incomplete or incomprehensible entries will be ineligible and may be disregarded. The Promoter accepts no responsibility for late, lost, incorrect, faulty or misdirected entries.
4.8 All entrants will provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as a Competition Finalist and/or the Winner, or if requested by the Promoter. In the event that any entrant refuses or cannot provide suitable proof, such entrant may be disqualified and (if the Winner) will forfeit the Prize in whole and no substitute will be offered.
4.9 The Promoter has the right to terminate or reject any Competition entry if the Promoter in its reasonable discretion believes that the Recording or the Performance is not original (is not created by the entrant), is obscene, defamatory or otherwise offensive or may damage the reputation or running of the Competition, if the entrant does not comply with any of the T&Cs or if the entrant’s behaviour is or is liable to be (in the Promoter’s opinion) offensive or damaging to the reputation or running of the Competition, to any other entrant or to the Promoter or to any third party associated with the Promoter or the Competition.
5. HOW THE COMPETITION WORKS
5.1 Each accepted Performance will be available at the Website for viewing by the public. Members of the public shall have the opportunity (via the Website) to comment on Performances and vote for their favorite Performance(s).
5.2 In the final weeks of the Competition the Website will provide details of the Competition grand final event, including the identity of the judges.
5.3 The 10 Competition Finalists will consist of 8 Finalists who have received the majority of votes from members of the public, via the Website and 2 wild cards, selected by the judges.
5.4 Prior to the Competition grand final, the judges will choose the 5 Grand Finalists, from the 10 Competition Finalists.
5.5 Each of the Grand Finalists will perform live at the grand final event before a live audience and the Competition judges. Failure to perform at the grand final event may result in disqualification from the grand final, as determined in the Promoter’s sole discretion. The Winner shall be determined in the judges’ sole discretion taking into account quality and originality of performance, and without reference to public votes. The judges’ decision is final and no correspondence will be entered into.
5.5 The winner of the grand final event shall be the Winner of the Competition, and shall receive the applicable winning Prize.
5.6 The Prizes are as detailed on the Website.
5.7 All other elements of the Competition are provided on the Website.
6. PERFORMANCES AND SUBMITTED MATERIAL
6.1 All entrants warrant (promise to the Promoter) that the Performances and all other materials submitted by the entrant during the Competition are, excluding only the Composition and Recording, wholly their own original creation and that their entry will not infringe the copyright or other rights of any person or third party.
6.2 To the extent that any other student from the School has helped in the creation of the Recording or other materials, or helped the entrant in any way in respect of the Performance, the entrant warrants that all necessary consents from such student(s) have been obtained by the entrant.
6.3 The Performance may be a performance of a Composition written by the entrant or written by someone other than the entrant, or a Composition which is partly written by the entrant and partly written by someone else. Prior to choosing the top 10 finalists, the entrant must advise the Promoter who wrote the Composition (if known).
6.4 The Performance may include (for example, as background music) a musical recording of someone else singing or playing. For example the entrant may perform to a recording by a popular artist. Alternatively, the entrant may sing a Composition themselves. Prior to choosing the top 10 finalists, the entrant must advise the Promoter who sings the Composition (if known).
6.5 The entrant understands it is important for the Promoter to know whether music and songs by other people are being used as part of the Performance. If the entrant provides false or insufficient information regarding the Performance and the Recording, it may be necessary for the Promoter to disqualify the entrant and exclude the entrant’s Performance from the competition. The Promoter may do this in the Promoter’s reasonable discretion and on notice to the entrant.
7. USE BY THE PROMOTER OF SUBMITTED MATERIAL
7.1 The Recordings and, if applicable, other materials provided by the entrant to the Promoter, will be displayed and broadcast on the Website, as part of the Competition.
7.2 In addition to performing the Recordings in the course of the Competition, the Promoter has the right to use all materials submitted by entrants for promotional purposes, in respect of the Competition. Such use may relate to the Competition, in which the entrant is involved, or any other Competition or aspect of the Competition.
7.3 By entering the Competition, each entrant grants the Promoter an exclusive licence during the Competition in which the entrant is involved, and a non exclusive license after that Competition, throughout the world, to use the materials in respect of the Competition, in the ways set out in these T&Cs. This licence applies in respect of music and/or lyrics written by the entrant. The entrant grants these licences on behalf of all parties involved in the Performance, having obtained the right to do so without restriction, as per 6 above.
7.4 The Promoter is entitled to edit, alter, reproduce, combine with other works and subject matter, digitise, publish, exhibit, communicate to the public and otherwise use the Competition entries, in connection with the Competition. However the Promoter will not commercially exploit (sell for financial return) the Performances, and will not change the fundamental nature of the Performance as submitted by the entrant.
7.5 The personal information supplied by entrants when entering this Competition (for example the entrant’s name) will be used by the Promoter to conduct the Competition, to contact entrants and for promotional purposes as set out in these T&Cs. The Promoter will not use or disclose an entrant’s personal information for any other purpose, without the entrant’s express consent. Use of information by the Promoter will be in accordance with the Privacy Policy.
7.6 In addition to the licence granted to the Promoter above in respect of materials submitted during the Competition, the entrant agrees the provisions of 8 and 9 below.
8. BINDING RECORDING AND MANAGEMENT ARRANGEMENTS
8.1 Each entrant accepts that if they are the Winner of the Competition they will enter into the Sony Recording Agreement and Sony Management Agreement, subject to agreeing terms of the Agreements. Also, Sony has the right in its discretion to enter into a Sony Recording Agreement and/or Sony Management Agreement with all or some of the Competition Finalists, and each entrant accepts that if he/she is a Competition Finalist, he/she may be required to enter into a Sony Recording Agreement and/or Sony Management Agreement, subject to agreement of terms of the Agreements.
8.2 Each entrant confirms that he/she has the ability to enter into the Sony Recording Agreement and Sony Management Agreement on an exclusive and ongoing basis, subject to agreement of other terms. Each entrant will remain free and able to enter into such Agreements, for the duration of the Exclusivity Period and in respect of the entire world. The entrant will not enter into arrangements which might conflict with these potential Agreements, during this period. If in respect of any Competition Finalist Sony does not exercise its right to enter into a Sony Recording Agreement or Sony Management Agreement, the entrant is free after the Exclusivity Period to enter into that type of arrangement with a third party.
8.3 Unless and until Sony agrees something different with the Winner and any Competition Finalist, each entrant will retain all ownership rights in the Recordings. Ownership is subject to the licence grant to the Promoter, at 7 above. The entrant understands and accepts that if he/she enters into a Sony Recording Agreement then rights in the Recordings and other recordings by the entrant will be granted exclusively to Sony.
8.4 Each Winner and any Competition Finalist to whom Sony offers a Sony Recording Agreement and/or Sony Management Agreement will be given the opportunity to review and negotiate the terms of the Agreements, using the services of a solicitor chosen by a majority vote of the Competition Finalists prior to determination of the Grand Finalists. The Promoter shall pay the costs of the solicitor. No other solicitor or third party may negotiate the Agreements on the entrant’s behalf. Each entrant accepts that if terms cannot be agreed by the entrant and Sony in respect of the Sony Recording Agreement and the Sony Management Agreement, then the Promoter may in its discretion remove the entrant from the Competition, and that entrant will not be eligible to progress further in the Competition.
9. BINDING PUBLISHING ARRANGEMENTS
9.1 Sony Publishing will offer the Publishing Agreement to the entrant whose original songwriting for the Competition is chosen by the panel of judges as being the best in that Competition. The Publishing Agreement will include a personal advance to the winning entrant of no less than $15,000.
9.2 Each entrant who submits original written music and/or lyrics to the Competition (a “Writer Entrant”) accepts that if they are the winner of the songwriting element of the Competition they will enter into the Sony Publishing Agreement, subject to agreeing terms of the Agreement.
9.3 Each Writer Entrant confirms that he/she has the ability to enter into the Publishing Agreement on an exclusive and ongoing basis, subject to agreement of other terms. Each Writer Entrant will remain free and able to enter into such Publishing Agreement, for the duration of the Exclusivity Period and in respect of the entire world. The Writer Entrant will not enter into arrangements which might conflict with this potential Agreement, during this period.
9.4 Unless and until Sony Publishing agrees something different with the winner of the songwriting prize, each Writer Entrant will retain all ownership rights in the songs they have written. Ownership is subject to the licence grant to the Promoter, at 7 above. The entrant understands and accepts that if he/she enters into the Publishing Agreement then rights in the songs written by the Writer Entrant will be controlled exclusively by Sony Publishing, on the terms which Sony Publishing and the winning Writer Entrant agree.
9.5 The winner of the songwriting element of the Competition will be given the opportunity to review and negotiate the terms of the Publishing Agreement, using the services of the solicitor referred to at 8 above. The Promoter shall pay the costs of the solicitor. No other solicitor or third party may negotiate the Publishing Agreement on the entrant’s behalf.
10. GENERAL
10.1 If for any reason the Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend the Competition. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or acts in any way which corrupts or affects the administration, security, fairness, integrity, reputation or proper conduct of the Competition or the Promoter and any entity connected with the Competition.
10.2 To the extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer on–line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on telephone networks or lines.
10.3 The Promoter is not liable for any costs incurred by the entrant in entering the Competition, including in circumstances where the Promoter cancels the Competition or (for reasons set out in these T&Cs) terminates the entrant’s entry to the Competition;
10.4 The Promoter and associated entities will not be held liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any Prize/s, except where caused by the liability of the Promoter and except for any liability which cannot be excluded by law.
SMS VOTING TERMS AND CONDITIONS
In the case of discrepencies between these Terms and Conditions and any other Terms and Conditions contained on the MySchoolAct Website, the Competition Terms and Conditions govern
MySchoolAct Pty Ltd (“Promoter”) SMS voting is the process of registering a vote for your favourite act featured on MySchoolAct via SMS (“SMS Voting” or “SMS Vote”) as advertised on the website MySchoolAct.com during the 2011 MySchoolAct Competition (“Voting Service”).
SMS Voting is governed by the terms of use, which are available at http://www.myschoolact.com/terms (“Terms & Conditions”). Your use of and/or access to SMS Voting constitutes your agreement to the Terms & Conditions. The Promoter reserve the right to amend the Terms of Use at any time. Since you are bound by these Terms of Use, you should ensure that you have read and fully understood them.
1. SMS Voting is open to users who are connected to the Telstra, Vodafone, Optus, Virgin or 3 mobile digital networks and participating service provider customers with SMS compatible mobile digital phones.
2. Only Australian residents are eligible to vote using the Voting Service. Unless otherwise stated, all timing is in Australian Eastern Standard Time.
TO VOTE BY SMS
3. To cast a SMS Vote for your favourite Act, using the Voting Service, you must send a text message from your mobile handset, with the name of the Act (as stated on the acts profile page on the MySchoolAct.com website) you would like to vote for to 1994 4144.
4. When registering your SMS Vote, you will only receive one SMS message in return to confirm your vote/s has been received for each voting period. Multiple votes are permitted but multiple replies will not be sent.
5. You must ensure that all care is taken when using the Voting Service. It is your responsibility to ensure that you dial the correct numbers or SMS the correct name. The Promoter and Beinteractive Pty Ltd (the “Voting Service Provider”) will not be liable for costs incurred, responses received or any other consequences of user error.
6. The Voting Service will be available from 6 July 2011 and will continue until the date notified to viewers as part of the 2011 MySchoolAct Competition.
7. The opening and closing times for the Voting Service using SMS Voting may vary. Under no circumstance will the Promoter or the Voting Service Provider accept any responsibility or liability for costs incurred or any other consequence as a result of a viewer submitting a SMS Vote prior to or after the respective voting lines have been announced as opened and/or closed. This also includes, and is not limited to errors made as a result of time differences between time zones in Australia. The Promoter reserve the right to amend the voting times at any stage as a result of but not limited to changes in the competition dates by the Promoter.
8. The Promoter and the Voting Service Provider reserve the right to keep all voting tallies confidential. No results other than what is required for the purpose of the format of the Promoter will be released to the public.
9. Votes registered using SMS Voting, will be charged at 55 cents (including GST).
10. Any SMS Votes submitted and received by the Voting Service Provider’s database after the specified voting period has closed will not be included in the vote tally for that period but will be charged 55 cents (including GST).
11. Except where not able to be excluded by law: a) all content for the Voting Service is provided "as is" and without warranties of any kind, either express or implied, b) Your mobile telephone carrier and its suppliers expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose, c) Neither your mobile telephone carrier nor the Promoter or the Voting Service Provider warrants that access to the Voting Service will be available, uninterrupted, free from delay or error-free or that any defects will be corrected.
12. (1) In order to provide a valid SMS Vote,
a.entrants must submit their entry via a mobile phone with a reply path.
b.The SMS message must have passed through a Telecommunications carrier's network to the Voting Service Provider’s database.
c.Automated votes submitted via computer modems, programs or any other means other than a mobile phone as specified above will be deemed invalid.
(2) In the absence of block, manipulative, unrepresentative or disproportionate voting patterns one valid SMS Vote will count as one vote, however the Promoter reserve the right in their sole discretion to disqualify or discount; -
a.any votes however cast (or individuals from voting), that tamper with, or attempt to tamper with, the Voting Service and/or the voting process, or
b.Any votes however cast (or individuals from voting, who) which corrupt or affect (or attempt to corrupt or affect) the administration security, fairness or integrity or proper conduct of a SMS Vote, the Voting Service and/or the voting process, or
c.Any votes that the Promoter considers to be manipulative, unrepresentative, disproportionate, obscene or offensive,
(3) Voters acknowledge that the Promoter’s decision in this matter is final and no correspondence will be entered into on this matter.
(4) Voters acknowledge that any SMS Votes that are discounted, invalidated or disqualified in accordance with the provisions of this Clause 12 will still be charged at the advertised rate.
13. The charges for all SMS Votes will appear on your next mobile / telephone bill. All queries relating to mobile / telephone bills should be directed to your mobile or telephone carrier.
14. All information, text, audio, material, graphics, software and advertisements contained in or forming the Voting Service (the "Content") are the property of the Promoter, its suppliers and/or licensors (including your telephone carrier) unless expressly indicated otherwise. The Content is protected by Australian and international copyright and trademark laws. You must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this Content in any way unless expressly authorised in writing by the Promoter.
15. SMS Voting is not a guaranteed delivery communication tool. The Promoter and the Service Provider cannot accept responsibility for any SMS Votes or messages not received, any SMS reply message or for any delay in the delivery of the SMS message due to technical disruptions, network congestion, network failures or for any other reason. A vote is validated and included in the tally following receipt into the Voting Service Provider’s database from the carriers.
16. If for any reason this Voting Service is not capable of running as planned, due to causes including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Voting Service Provider which corrupt or affect the administration security, fairness, integrity or proper conduct of this Voting Service, the Voting Service Provider reserves the right in its sole discretion to disqualify any individual who tampers with the Voting Service and/or process, take any action that may be available, and to cancel, terminate, modify or suspend the Voting Service.
17. Voters acknowledge that if an Act or Acts for which they have voted is eliminated or disqualified from the Competition for any reason (in respect of which the Promoter’s decision is final and no correspondence will be entered into) then SMS Votes made for any such Act or Acts will not count in determining any Act’s or Acts’ progress or position in the competition for the Promoter but will still be charged at the advertised rate.
GRAND FINAL WORKSHOP AND LIVE PERFORMANCE TERMS & CONDITIONS
In the case of discrepencies between these Terms and Conditions and any other Terms and Conditions contained on the MySchoolAct Website, the Competition Terms and Conditions govern
1. ELIGIBILITY FOR SELECTION
1.1. The grand final workshop and live performance ("Grand Final Event") is only open to Grand Finalist of the MyShcoolAct competition.
1.2. Each Grand Finalist will need to bring one responsible parent or guardian (one guardian per Act) with them to the Grand Final Event.
2.TRANSPORT
2.1. The Promoter will arrange for return flights to the Grand Final Event to be booked for each member of Grand Finalist Acts and their one Guardian.
a. Flights will be non-transferable
b. Flights will not be replaced if Grand Finalist or Guardian's miss them
c. Excess baggage charges will need to be paid for by the Grand Finalist and their guardian's
2.2. The Promoter will arrange for crucial ground transport.
a. The Promoter will arrange for transport for Grand Finalist and their Guardian between the airport and the hotel booked by the Promoter for the Grand Final Event
b. The Promoter will arrange for transport to and from the Grand Final Event venues
c. Grand Finalist and their guardian who normally reside within NSW will not receive flights, nor will they be reimbursed for flight costs
3. ACCOMMODATION
3.1. The Promoter will arrange for accommodation for each member of the Grand Finalist Act and their one guardian.
a. Accommodation that is booked cannot be changed
b. Accommodation will be non-transferable
c. The Promoter will not cover additional rooms, longer stays, damage to the room or incidentals such as mini bar, room service, internet, phone line, dry cleaning etc
f. Each Grand Finalist will be required to provide a credit card upon arrival to cover any additional charges on the room
g. Grand Finalist and their guardian whom normally reside in Sydney will not receive accomodation, nor will they be reimursed for accomodation costs
4. FOOD & BEVERAGE
4.1. The Promoter will provide lunch with vegetarian options for members of Grand Finalist Acts and their one guarrdian during the Grand Final Event
4.2. The Promoter will provide dinner for members of Grand Finalist Acts and their one guardian on the night of the Live Performance
4.3. Water will be made available for members of Grand Finalist Acts and their one guardians at all times.
4.4. Breakfasts, snacks and all other meals will need to be paid for by the Grand finalist and their guardian
5. GRAND FINALIST PROPERTY AND GEAR
5.1. The property of the Grand Finalsit will be their responsibility for the duration of the grand final event. The Promoter will not be held responsible for lost, stolen or damaged equipment.
a. The Promoter will not provide replacement equipment if lost, stolen or forgotten
b. Grand Finalist will not take any property that does not belong to them
c. Grand Finalist agree to have their belonging searched before the event by a member of security or by a venue employee
6. FILMING & PHOTGRAPHY
6.1. Grand Finalist and their Guardian agree and understand they will be filmed and photographed during the Grand Final Event.
6.2. The footage and images from Grand Final Event may be used online, on paid and free to air television.
7. GRAND FINAL EVENT
7.1. Each Grand Finalist will be supplied with an official Grand Final Event running sheets, featuring specific guidelines and important information regarding sound check and playing times. It is the responsibility of each Grand Finalist to adhere to these guidelines and playing times.
a. Grand Finalist will arrive to the Grand Final Event venue at the required time
b. Grand Finalist will be given a compulsory sound check before their playing time
c. The timeslot allotted to each Grand Finalist is final and not up for negotiation
d. The timeslot does not reflect the rank of the Grand Finalist
7.2. Whilst performing onstage at the Grand Final Event, all Grand Finalist will remain on stage for the entire set time
a. Grand Finalist will not throw any instrument or objects into the crowd
b. Grand Finalist will not bring members of the audience on stage with them
c. Grand Finalist will not use profanities or engage in a inappropriate manor with the audience
d. Grand Finalist will follow every instruction given to them by the sound and stage crew at the Grand Final Event
7.3. Grand Final Event 2011 Workers Passes will be supplied to each member of Grand Finalist Acts and their one gurdian.
7.4. Grand Finalist and their Guardian remain representatives of the promoter for the entire Grand Final Event
a. Grand Finalist and their guardian will not be intoxicated during the Grand Final Event, otherwise persons will be instructed to leave the event
b. Underage members of the Grand Finalist Acts will not be allowed to consume alcohol or tobacco products during the Grand Final Event, otherwise persons will be made to leave the venue
c. Grand Finalist and their guardians will not be allowed to carry or consume ANY illegal substance. Grand finalist and guardians found with illegal substances will be required to leave the venue and will be handed over to local governing officials to be prosecuted
d. Grand Finalist and their guardians will respect the privacy of other Grand Finalist playing on the same stage
e. Grand Finalist and their guardians will treat their dressing room with respect and will not bring any unauthorized persons to the vicinity

In the case of discrepencies between these Terms and Conditions and any other Terms and Conditions contained on the MySchoolAct Website, the Competition Terms and Conditions govern
1. ELIGIBILITY FOR BIG DAY OUT 2012
1.1. The competition: Win a Spot on the 2012 Big Day Out in Your Nearest Capital City, with Thanks to Motorola ("BDO Competition") is only open to eligible entrants of the MyShcoolAct competition.
a. Entry is only open to VIC, NSW, QLD, WA, SA, ACT, TAS and NT residents
b. Individuals who are under 18 years of age must obtain consent from their parent/legal guardian to participate in this promotion
c. Individuals/Acts will need to select one responsible guardian to accompany them to, from and during Big Day Out 2012.
d. Members of chosen Acts who are under 15 will be allowed to play on stage at the Big Day Out 2012, but will not be permitted to participate in the rest of the festival and will be escorted out of the festival premises following their performance.
2. SELECTION MECHANIC
2.1. National applications will be in the draw to play at their nearest Big Day Out in 2012. The breakdown of competition areas is as follows:
a. Acts from New South Wales and the Australian Capital Territory will be in the running to win a place at Sydney’s Big Day Out 2012
b. Acts from Queensland and the Northern Territory will be in the running to win a place at the Gold Coast’s Big Day Out 2011
c. Acts from Victoria and Tasmania will be in the running to win a place at the Melbourne Big Day Out 2012
d. Acts from South Australia will be in the running to win a place at the Adelaide Big Day Out 2012
e. Acts from Western Australia will be in the running to win a place at the Perth Big Day Out 2012
2.2. Each Big Day Out 2012 spot will be allocated by a Big Day Out representative who will decide the Act from the Top 3 from each competition area as stated above.
2.3. When a winner is selected, the chosen Act will have one (1) week to commit to their performance slot at their nearest Big Day Out.
a. In the event that the chosen Act or performer is unable to attend their performance slot at their nearest Big Day Out, their time slot will be given to the next runner up, as per the discretion of the Big Day Out representative.
b. The Act will need to select a responsible guardian to accompany them to, from and during Big Day Out 2012.
3. MONETARY REQUIREMENTS
3.1. Chosen Acts and guardians will be solely responsible for all financial ramifications involved with playing at Big Day Out 2012.
a. Travel, both air and ground to and from the festival will need to be booked and paid for by the winning act
b. Big Day Out will provide parking for one (1) vehicle in Artists Parking
c. Food and Drinks during the Big Day Out festival will be paid for by the chosen Act
4. AT THE BIG DAY OUT 2012
4.1. Each Act will be supplied with an official Big Day Out 2012 running sheet, specific guidelines and important information regarding sound check and playing times. It is the responsibility of each Act to adhere to these guidelines and playing times.
a. Acts will arrive to the Big Day Out site at the required time
b. Acts will be given a compulsory line or sound check before their playing time
c. The timeslot allotted to each Act is final and non-negotiable
d. Acts will be given a specific set time as decided by Big Day Out, Acts will not play longer then their allocated time.
4.2. Whilst performing onstage at Big Day Out 2012, all Act members will remain on stage for the entire set time
a. Acts will not throw any instrument or object into the crowd

4.3. Big Day Out 2012 Workers Passes will be supplied to each member of each chosen Act as well as the one (1) guardian.
a. These passes are valid for the one (1) Big Day Out 2012 festival
b. Passes remain the property of Big Day Out
c. Passes are non-transferable and are strictly to be used for the Act member or guardian it is provided to
d. Lost or damaged passes will not be replaced
e. Acts will hand in their passes at the conclusion of their gig
f. Acts will not be allowed to enter any restricted area, stage or dressing room
g. Acts will each be provided with a drink or catering pass
h. Acts and Guardians are welcome to stay for the remainder of the festival and will be provided with a ticket, regular ticket guidelines will apply – Underage students (under 15 years old) will need to leave the premise
4.4. The property of the chosen Act will be the responsibility of the members and guardian of each Act
a. Big Day Out does not take responsibility for any item belonging to the chosen Act
b. Big Day Out will not provide replacement gear if lost, stolen or forgotten
c. Acts will not take any property that does not belong to them
d. Acts agree to have their belonging searched before and after the event by a member of security or by a Big Day Out employee
4.5. The chosen Act, including members and guardians remain representatives of MySchoolAct for the entire Big Day Out festival
a. Members of Acts and guardians will not be intoxicated during the Big Day Out 2012, otherwise persons will be made to leave the festival grounds
b. Underage members of chosen Acts will not be allowed to consume alcohol or tobacco products during Big Day Out 2012, otherwise persons will be made to leave the festival grounds

1.3. The number of Acts per school does not affect the entering process.

2. ENTERING INTO THE COMPETITION
2.1. To enter, High Schools will send their entry to comps@myschoolact.com
2.2. High Schools are able to submit entries in any format they wish; eg: images, videos, MP3s, PowerPoint etc.
2.3. The competition will close at 5:00pm (AEDT) Friday 2 December 2011
2.4. Any entries received after the closing date will not be eligible.
2.5. Entries will be judged and a winner will be selected by a Motorola representative.
3. THE PRIZE PACKS
3.1. The Ultimate Education Prize Pack (Winning Prize Pack) will contain contents as described on the MySchoolAct website. The value of the prize pack is approx. AU$3,910.00.
